Is Delta-8 THC Legal in Nevada? (2022)

Do you enjoy smoking weed and travelling the world? Enjoying weed in various states can be daunting, especially if you’re not clued-up on the laws beforehand. So, you’ve planned a trip to Las Vegas, and you’re ready to have some fun. But you’re probably wondering, is weed legal in Nevada?

The laws regarding cannabis use have changed dramatically in Nevada in the past five years. Although Delta-8 THC is federally legal across America, many States have chosen to contradict the legislation and ban the isomer. Delta-8 THC is one of the more recent hemp products and is federally legal to buy, sell, consume, and produce. However, this is not the case in Nevada.

Unfortunately, Nevada is one of the few States to ban Delta-8 THC. Let’s take a closer look at the laws surrounding Delta-8 THC in Nevada, how it differs from Delta-9 THC, and what products you can legally consume while in Las Vegas.

What’s the difference between Delta-8 THC and Delta-9 THC?

Typically, when people talk about THC – the compound in cannabis that gets you “high” - they mean Delta-9 THC. There are three isomers of this molecule, Delta-8 THC, Delta-9 THC and Delta-10 THC. Each of these molecules have slightly different chemical structures, which is responsible for the varying effects that these isomers can have on your body.

Delta-9 THC is considerably more potent than Delta-8 THC and is believed to be about as twice as strong. The side effects of Delta-9 THC can sometimes have more of an effect on your cognitive skills and can contribute to increased feelings of anxiety and paranoia. When it comes to the health benefits of Delta-8 THC and Delta-9 THC, they are very similar and can be used to treat various conditions, from depression to arthritis.

While Delta-8 THC and Delta-10 THC are legal at a federal level, Delta-9 is not. Some States have made one or all isomers illegal, so it’s always important to check before you travel.

Is Delta-8 THC legal in Nevada?

Delta-8 THC is not legal in the State of Nevada. Despite the unconventional 2018 Farm Bill, which made the all-important distinction between cannabis and hemp, Nevada has still chosen to ban the isomer. The bill defines hemp as cannabis with 0.3% or less Delta-9 THC, and therefore, all hemp and hemp-derived products, including Delta-8 THC are legal.

However, that State of Nevada chose to take a different stance when it comes to Delta-8 and Delta-9 THC. Nevada is a cannabis-friendly state and has banned Delta-8 THC, but it still allows the use of Delta-9 THC regardless of its concentration or origin.

Can you order Delta-8 THC using your medical card in Nevada?

The short answer is no. You cannot get a medical card for Delta-8 THC in Nevada. Delta-8 THC is completely banned in Nevada, and so it can’t be used for medical purposes either.

What’s the future of Delta-8 THC in Nevada?

Nevada is currently one of the most cannabis-friendly states in the whole of America, and yet, they still chose to make Delta-8 THC illegal. Despite the milder effects of Delta-8 THC compared to Delta-9 THC, if you are caught in possession of Delta-8 THC, you may face criminal charges.

However, you can purchase and consume Delta-9 THC products in Nevada – if you’re 21 or older! You can enjoy Delta-9 THC products without the need for a medical card. Purchasing your Delta-9 THC products online is often the most convenient option. Dispensaries are available if you wish to get advice on which product is best for you, as some people may prefer edibles to vapes, for example.

The United States is slowly moving towards a future where cannabis is legalized and considering Nevada is pro-cannabis, it’s likely that Delta-8 will become legal at some point soon. Fingers crossed!
